Human Rights: Perspectives of Natural Law Jurists

Dr. Agustín Herrera participated in the publication of a work that delves into the ethical and legal foundations of human rights from a natural law perspective.

 

On February 18, 2025, Dr. Agustín A. Herrera Fragoso, associate researcher at our School of Bioethics, presented the second volume of the book Human Rights: Perspectives of Natural Law Jurists entitled Individual, Civil, Social Rights and Globalization in the Optics of Human Rights.

 

The book, structured in four parts and 17 chapters, brings together the reflections of 18 authors from different regions of the world, who discuss their vision of human rights, which derive from human dignity and should underpin ethical and legal arguments without the need for specific classifications for different groups. The central idea of ​​the work maintains that human dignity is prior to any legal formulation and that, therefore, human rights are universal and inalienable.

 

The topics addressed in this publication include marriage and family, conscientious objection, freedom of expression, property and self-determination of peoples. The impact of globalization on the understanding and application of human rights is also analyzed, warning of the risks of prioritizing particular rights over collective rights without an adequate ontological basis. Another key aspect explored is the difference between natural rights and artificial legal constructions, highlighting the importance of applying a lusnaturalist approach in the recognition of fundamental rights.

 

The text also emphasizes that human rights must be understood as belonging to the ontological dignity of persons, without extending to entities lacking conscious rationality. Based on this premise, the authors develop a profound reflection on the essence and application of human rights in the contemporary context.

 

The Anáhuac Community congratulates Dr. Herrera Fragoso, as well as the authors and collaborators for this relevant academic contribution that offers a solid analysis that argues on the foundation of human rights from a philosophical and legal perspective.
